Dear Sir,
     We have to re-new the Love of Virtue, Justice, Reciprocity, in our American Society.  Love of Virtue predates although it is all too often erroneously linked with the weakness of Communism and too little associated with Montesquieu's original meaning -- the willingness to put the interests of the community ahead of private interests

     Neal K. Katyal, Lead Counsel in the Supreme Court case that established civil rights for detainees at Guantanamo Bay,[1] further commented I think succinctly, "To be sure, there is always some political accountability when the legislature absolutely deprives aliens of their rights. For example, American citizens could be aghast at the MCA[2] and vote out those who voted for it in Congress. But that form of accountability is too weak, as it posits an uberempathetic voting population so concerned for the rights of others that they will vote on the basis of policies that do not impact their own lives. This is just too fanciful. Virtual representation cannot be effective if it depends on heroic assumptions of empathy, just as our early countrymen recognized by placing the Privileges and Immunities Clause in Article IV and writing McCulloch with virtual representation in mind."[3]  The Supreme Court has said as stated prior, "But it must also be recognized that the Bill of Rights is particularly intended to vindicate the interests of the individual in the face of the popular will as expressed in legislative majorities; at the very least."[4]
     
     "For this is the message that ye heard from the beginning, that we should love one another."[5]

     "Thou shalt not avenge, nor bear any grudge against the children of thy people, but thou shalt love thy neighbour as thyself."[6]

     "In all that we do, we must be guided by that simple command that binds all great religions together: Love thy neighbor as thyself."[7]

     "We know too that whatever our differences, there is one law that binds all great religions together. Jesus told us to "love thy neighbor as thyself." The Torah commands, "That which is hateful to you, do not do to your fellow." In Islam, there is a hadith that reads "None of you truly believes until he wishes for his brother what he wishes for himself." And the same is true for Buddhists and Hindus; for followers of Confucius and for humanists. It is, of course, the Golden Rule—the call to love one another; to understand one another; to treat with dignity and respect those with whom we share a brief moment on this Earth."[10]

     The fear mongers want to frame the issue as the weakness of Communism v. the strength Capitalist's Free Markets.  The pursuit of Justice requires that we ask "do we live as animals, survival of the fittest, or are We the People civilized by our assertion of the democratically derived and sustained supreme law of the land, the Constitution for the United States of America?

     We the People sought to separate ourselves from the animals, the survival of the fittest and the divine right of kings with our Constitution for the United States of America.  I quote from James Madison in the Federalist Papers (#51) at the ratification of the Constitution for the United States of America:
     "Justice is the end of government. It is the end of civil society. It ever has been and ever will be pursued until it be obtained, or until liberty be lost in the pursuitIn a society under the forms of which the stronger faction can readily unite and oppress the weaker, anarchy may as truly be said to reign as in a state of nature, where the weaker individual is not secured against the violence of the stronger; and as, in the latter state, even the stronger individuals are prompted, by the uncertainty of their condition, to submit to a government which may protect the weak as well as themselves; so, in the former state, will the more powerful factions or parties be gradually induced, by a like motive, to wish for a government which will protect all parties, the weaker as well as the more powerful." 
The power of any group is dependent on its cohesion.  Cohesion within a group requires the interests of the individual be, to some extent, deferential to the group.  American's feel emotionally repulsed by the Love of Virtue -- the willingness to put the interests of the community ahead of private interests -- because of its erroneously asserted though non-controlling link to the fall of communism.
     Reciprocity requires the administration of Justice based on the Jury System, without any absolute immunity.  We the People need to take responsibility for our actions amongst ourselves and as a responsible member of the world community.  There is no such thing ABSOLUTE IMMUNITY!!![11]

Obama the Socialist? Not Even Close

     There is a BIG difference between Communism and Socialism.  Communism as implemented by Lenin. Mao and others was a dictatorship overseen by an oligarchy.  Communism as implemented by Vladimir Lenin's Russia (1917-1924), Mao Zedong' China (1949- 1976) and others although originally based on the good intentions of Marx's socialism, a republican classless society, never achieved nor really even pursued that goal.

     Socialism as I see it can be likened to a love of virtue, reciprocity and Justice, ESSENTIAL components of a republic as espoused by Montesquieu in 1748 with "The Spirit of the Laws" – more than to Karl Marx's Communist Manifesto (Das Kommunistische Manifest) 1848.  The "The Spirit of the Laws" (1748) was one of the founding fathers essential textbooks at the founding of our nation in 1776.

I think he was talking about the love of virtue and what would be come known as SOCIALISM even though he had no knowledge of Karl Marx as yet.

      On July 9, 1868, the 14th Amendment, which granted citizenship, due process and equal protection to "all persons born or naturalized in the United States," was ratified by South Carolina and Louisiana, allowing it to become part of the U.S. Constitution.
Why do we not have its protection today?
      We the People have never have been able to rely on the Courts to provide due process and equal protection. 
      Why would We the People have enacted the Constitution, much less the 14th Amendment, as the Supreme Law of the Land[4] to replace the divine right of the King, if it was our intent to give absolute immunity sub silentioto expmpt[5] ANYONE i.e., much less  "all persons -- governmental or otherwise -- who were integral parts of the judicial process" (Briscoe v. LaHue, 460 U.S. 325 (1983)), especially those tasked with judicial,[6] prosecutorial[7]and enforcement[8] power, all evidence to the contrary, from its binding authority[9] and consequence?[10]
      How can the malice, corruption, dishonesty and incompetence[11] condoned and supported by Supreme Court precedent be constitutional in a SANE government of the people, by the people and for the people?
      This is a massive malicious, corrupt, dishonest and incompetent[12] self-serving conspiracy against rights!!!
      Historically, the claim of precedent and / or consensus has been the first refuge of scoundrels; it is a way to avoid debate by claiming that the matter is already settled.  Absolute Immunity even in the supreme Court has NEVER been established without, in most cases, multiple dissenting opinions. 
      To assume that the founding fathers, who had enacted the Constitution of the United States of America as the supreme Law of the Land, intended sub silentio to exempt[13] ANYONE, all evidence to the contrary, especially those tasked with judicial,[14] prosecutorial[15]and enforcement[16] power from its paramount binding authority is an incredible fantastic or delusional scenario.[17]

This embarrasses the future and the past[19]

      There are no royal absolutely immune ruling persons/class in this country i.e., no titles of nobility.[20]  We the People incorporated ourselves, in 1788, into a government of the people, by the people and for the people to secure the Blessings of Liberty to ourselves and our Posterity with a lawfully un-abridge-able right of the people to justifiably petition the Government for a redress of grievances.[21]
      How can the Supreme Court, a delegated authority, acting under a sworn to constitutional commission award themselves and others "absolute immunity"[22] from said constitutional commission to "do not only what their powers do not authorize, but what they forbid"[23] i.e., the "deprivation of any rights, privileges, or immunities secured by the Constitution and laws of the United States of America?"[24] by DENYING the constitutional assurance of governmental accountability with 1st and 7th Amendment Justice, law and equity?[25]
      We the People have fallen under the despotic[26] spell of the concentrated power[27] in the Supreme Court that has created ABSOLUTE POWER[28] from ABSOLUTE IMMUNITY for the "malicious or corrupt" judges,[29] the "malicious or dishonest" prosecutor, [30] the "knowingly false testimony by police officers"[31] and "all (malicious, corrupt, dishonest and incompetent[32]) persons -- governmental or otherwise -- who were integral parts of the judicial process" [33] acting under color of law to wit, ABSOLUTE CORRUPTION.[34]

Douglas said it in 1961 and 1967. [41]  Mr. Lowe of Kansas and Mr. Rainey of South Carolina respectively said it originally in 1871[42]

Thompson No. 09–571 Decided March 29, 2011 and "fraud upon the court" with Ashcroft v. al-Kidd No. 10–98  Decided May 31, 2011!!!Judicial modesty is one of the best possible qualifications for a Supreme Court Justice, a position that offers so much untrammeled power and brings so much temptation along with it.
      The Right of Petition is the right to substantive justice between the government and the people.  We do not have any individually enforceable rights in this country, "Everybody, BUT the innocent victim, has "ABSOLUTE IMMUNITY"[49]" for the "deprivation of any rights, privileges, or immunities secured by the Constitution and laws of the United States of America"[50] e.g., "To Kill a Mocking Bird, The Denial of Due Process,"[51] "The Exclusionary Rule," "Grounds for Impeachment."
      Most of the 99% of Americans have not had the pleasure and are silently intimidated by the prospect of being dragged through our corrupt COURTS kicking and screaming!!!!!!  I have been kicking and screaming for nearly 9 years.[52]  I have suffered through 411 days of illegal incarceration, 5 years of homelessness and two psychological examinations.  I ask you to review Jeep v Obama 8th Circuit Court of Appeals case #11-2425, Jeep v United States of America 10-1947," Jeep v Bennett 08-1823, "Jeep v Jones 07-2614, and the most humble Petition for a Wirt of Certiorari to the Supreme Court 07-11115 and 11-8211."
      We hold a "4-Year-Old Can Be Sued."[53]  We can bail out the automakers to the tune of $75-$120+ billion. [54]  We can spend $1.3 trillions and rising on an attempt at nation building in Iraq and Afghanistan. [55]  We can make-work to stimulate the economy with $787 billion. [56]  We can bail out the Banks to the tune of $2.5 Trillion. [57]  But we cannot AFFORD to even consider the possibility of negligence, malice and corruption of "our chief justice (judges), our officials (prosecutors), or any of our servants (law enforcement)" [58]  and compensate the victims?
That is INSANITY!!!!!!!!!!!!!
      I have referenced "To Kill a Mocking Bird, The Denial of Due Process," in several of my papers, I do so only because the facts of the case in "To Kill a Mocking Bird" are generally known.  The abuses are happening EVERYDAY in REAL LIFE Mr. Thompson (No. 09–571),[59] Mr. Smith (No. 10-8145), [60] Mr. al-Kidd (No. 10–98)[61] and myself (USCA8 No. 11-2425).[62]   The fact that "With 5% of the world's population, our country now houses nearly 25% of the world's reported prisoners"[63] PROVES "We the People" have NO ENFORCEABLE RIGHTS IN America today!!!!!!!!!!!!

[20] You some how want to argue that "the grant of Nobility" was about something other than the ROYAL Status of IMMUNITY. You want to argue that hereditary property rights were linked to a Colonial interpretation of Nobility?  That would undermine Free-Enterprise.
Anyone that wants to assertion "the prohibition of titles of nobility' was meant to be anything more than a prohibition of theabsolute immunity of the nobility had been allowed, need only read the Petition of Right 1628 and note the consistent aversion to the asserted immunity of the nobility.
There is not now and there was not then any titular value other than Royal status as immunity - being above the law?  Did NatKing Cole violate the constitution?  No one is that petty.  Nobility conferred ONE-THING of interest now and then, IMMUNITY from the RULE OF LAW!!!!!!!!!!!!!

[26] Montesquieu in his "De l'Espirit des Lois" (1748) (The Spirit of the Law) defines three main kinds of political systems: republican, monarchical, and despotic.  Driving each classification of political system, according to Montesquieu, must be what he calls a "principle". This principle acts as a spring or motor to motivate behavior on the part of the citizens in ways that will tend to support that regime and make it function smoothly. For democratic republics (and to a somewhat lesser extent for aristocratic republics), this spring is the love of virtue -- the willingness to put the interests of the community ahead of private interests. For monarchies, the spring is the love of honor -- the desire to attain greater rank and privilege. Finally, for despotisms, the spring is the fear of the ruler.    We the People have currently despotic system in that we have NO enforceable rights in America TODAY!!!!!!!!!!

This defect in the administration of the laws does not extend to other cases. Vigorously enough are the laws enforced against Union people.
