I need access to my Constitutional Rights! This is a Jury Trial DEMAND!
I am a 70-year-old retired senior, lifelong State of Missouri citizen, living exclusively on my cost of living adjusted social security[3]. In July of 2021, when I turned 65, I was happily put on “Obama[4]” Medicare.
Social Security originally deducted the cost of Obamacare from my sole sources of income, cost of living adjusted (COLA) social security. I objected and was told to talk to State of Missouri. Which I did and I was covered by State of Missouri, July of 2021 through April 2024, per the “COLA” Obamacare “5% disregard” (138% of the Federal Poverty level) final rule issued July 15, 2013 and Missouri Amendment 2, Medicaid Expansion Initiative (August 2020).
Where some states have leeway under the National Federation of Independent Business v. Sebelius, 567 U.S. 519 (2012). State of Missouri DOES NOT! State of Missouri is subject to Missouri CONSTITUTIONAL Amendment 2, Medicaid Expansion Initiative (August 2020) as judicially confirmed[5] prior to the election, as ratified at the election[6], as reconfirmed after the election by the Missouri State supreme court[7] and as all confirmed and to be enforced by the Governor of Missouri[8].
Constitutional Protection: because the expansion is embedded in the state constitution, it prevents state lawmakers from altering or repealing core eligibility through standard legislative or appropriations bills.
Now I am indigent, I am retired, I do not wear coat and tie, I do not even wear long pants in warm weather, but I have constitutional rights! Originally, I made the State of Missouri aware of my situation via a 10-page letter on Wednesday, March 27, 2024 and I have been consistently and relentlessly pursuing my Constitutional rights ever since.
I can substantiate the current overpayment as $5,224.80. State of Missouri made a payment against the total due on 7/3/26 of $2,126.00 (see BNC#: 26DZ071E97498-A).
Because State of Missouri has been so flagrant and malicious in their disregard for my constitutional rights as I struggle to survive on my Affordable Care Act (ACA), Modified Adjusted Gross Income (MAGI) fixed income beneath the “COLA” Obamacare “5% disregard” (138% of the Federal Poverty level) final rule issued July 15, 2013 and Missouri Amendment 2, Medicaid Expansion Initiative (August 2020) level for the 28+ months, I am seeking punitive damages of $140,000.00 leaving a balance due of:
One hundred forty-three thousand ninety-eight dollars and eighty cents $143,098.80
