I was working for Save-A-Lot
a limited assortment grocery headquartered in St. Louis but EXPANDING in the Mid-Atlantic
Region. I was in construction, a part of
the Market Development department. There
was a plan to add 20 +/- locations in Maryland and Virginia over a two-year period.
Every Tuesday, I NORMALLY, flew out of STL
to BWI
to scout and oversee the build out of the new Save-A-Lot locations
in Maryland and Virginia. I typically stayed
in Owings Mills, Maryland. I rented a car
and worked the area, and flew back to St. Louis normally Thursday, sometimes Friday.
September
11, 2001 was obviously different.
I had been late and rushed to board the plane at 6:50AM CDT (8:50AM EDT). No one on board was aware of the (7:46AM CDT) 8:46AM EDT -
Flight 11 crashes into the north face of the North Tower (1 WTC) of the World
Trade Center, between floors 93 and 99.
I had been late and I was not sitting in my usual “front row”
“frequent flyer” location. I was sitting
in the back of the plane oblivious to anything in the world outside. None of the other passengers seemed unusually aware of any events outside.
At 9:37AM EDT Flight 77 crashes into the western side of the
Pentagon and starts a violent fire.
The SCATANA order for
a national ground stop, was issued 9:42AM EDT on the morning of September 11, 2001,
after the Air Traffic Control System Command Center learned
from news reports that a plane (American
Airlines Flight 77) had crashed into the Pentagon, "ordered
all FAA facilities to instruct all aircraft to land at the nearest airport"
(of sufficient runway length).
Pulling a U-Turn in a 747 is a noteworthy experience to say the
least. But the U-turn was the first inclination
of any issue the passengers had. I had a
window seat and as a REGULAR knew the flight path like the back of my hand. I immediately perked up.
After settling into a new flightpath, the pilot came on the
PA system and told us the facts, as he knew them, “Terrorist had attacked the pentagon
and we were being diverted.” He never
told us where. He came back on rather quickly
to say, that there were “NO TERRORIST on our plane.”
After 30-40 minutes we circled and landed at the Louisville
International Standiford Field. I had
been here before, the air field looked like a PARKING LOT for commercial airliners. We spent at least an hour waiting to get a
gate to off load.
Having been informed that we were ALL going to be forced to disembark. I knew as a frequent flyer that we were not
getting back on this plane. As it turned
out there had been three Save-A-Lot
employees on the flight. We called our
home office. They were happy to hear from
us, and that we were ALL safe. They
offered two solutions, get a room or rent a car and drive back. I took off at a sprint through the airport,
with my prior knowledge of the layout to get to the rent-a-car counters. I rented the only thing available a minivan
and we spent the day calling in with family and friends on our way back to St.
Louis. We arrived back at St. Louis
3-4:00pm CST, the headquarter office had closed.
Everybody had gone home.
I went home, spent the evening with my family and went into the headquarter office to work the next day. I
scheduled a fight out to BWI for Thursday September 13, 2001 with a return
flight for Friday September 14, 2001. I flew
out as scheduled Thursday September 13, 2001, took care of business, Thursday-Friday.
My Friday afternoon flight was canceled,
I caught a standby flight on Saturday September 15, 2001. I was home by noon.
At work at the home office Monday September 17, 2001 I was
informed that all corporate travel had been canceled for the foreseeable
future. The foreseeable future lasted
until Tuesday September 25, 2001. I flew my regular route to BWI Tuesday September 25, 2001 and home Thursday September 27, 2001.
I flew every week, at least twice a week for the next 6
months. I
was never deterred or too afraid to fly!

The Idea that women need the ability to make accusations and not have to sustain them with "due process of law" is proverbially tantamount to the worst of Jim Crow's "Southern Horrors: Lynch Law in All Its Phases" by Ida B. Wells - in its modern manifestation "Jane Crow" sexual discrimination!
On November 3, 2003 (7:55 pm), I was getting ready to watch Monday Night Football with my son. There was a knock on the front door. My wife had just called my son from the garage. She was just coming home. I thus went to answer the front door alone.
Two police officers, with guns came in. They served me with an exparte order of protection and explained that they were going force me from my home.
It is an accepted legal axiom “possession is 9/10 of the law.” I would assert in the “Jane Crow era” possession is 10/10 of the law.
It has been nearly 15 years, and to this date, the deprivation of my paternal, property and liberty rights WITHOUT reasonable probable cause has never been recognized. I was, literally, forced into a “Jane Crow era” all-consuming conspiracy against rights (18 U.S. Code § 241).
Since then I have been impoverished / homeless for 11 years, I was jailed for 411 days for charges that were dismissed all in my pursuit of my appeal to the Article III “Black Robed Royalist."
The “Jane Crow” era has NOW been PROVEN by socioeconomic statistical RESEARCH. "Jane Crow" discrimination is REAL! FATHERS ARE DISFAVORED by domestic relations law in the United States of America! With the birth rate down by 48% since 1960 and teen pregnancy down by 65% just since 1990 -- single motherhood is UP by 700% since 1960 (40% of births were to single mothers in 2015 v. 1960's 5%). This affects 35% of society (40%-5%=35%). Per the report's authors, these figures stand without regard to race or income.
The law is on OUR SIDE, it is just that we do not have ACCESS to DUE PROCESS OF LAW to prove it!!!

The original court order at
the center and inception of this issue, in 2003, was NOT “a facially
valid court order”[7] the issuing Judicial Officer
did not have “probable cause, supported by Oath or affirmation”[8] for the stated charge[9] and thus it was "taken in
a complete absence of all jurisdiction."[10] Clearly to any facially[11] reckonable[12] reading of Due Process rights,
reasonable probable cause is a prerequisite for government action/jurisdiction. There are "absolutes" in our Bill
of Rights, and they were put there on purpose by men who knew what the words meant and meant their prohibitions to be
"absolutes."[13]
In the 9.58 years[14] since there has never been any
mention of “exigent circumstances” nor “good faith” mistakes there for the
order stands on its own as brazenly NOT “a facially valid
court order.”[15]
Since the civil domestic issue has been ongoing for 9.58 years it is, as
it was for Bivens, “damages or nothing.”[16]
Since 2003 the Commissioner Jones and the original petitioner Sharon G.
Jeep both contradicted their original assertions, although neither took the
“Good Faith” requisite of RESPONSIBILITY!!!
I again quote Justice Hugo Black:
“The Fourth Amendment provides:
The right of the people to be secure in their persons, houses, papers,
and effects, against unreasonable searches and seizures, shall not be violated,
and no Warrants shall issue, but upon probable cause, supported by Oath or
affirmation, and particularly describing the place to be searched, and the
persons or things to be seized.”
The use of the word "unreasonable" in this Amendment means, of
course, that not all searches and seizures are prohibited. Only those
which are unreasonable are unlawful. There may be much difference of
opinion about whether a particular search or seizure is unreasonable and
therefore forbidden by this Amendment. But if it is unreasonable, it is
absolutely prohibited.
Likewise, the provision which forbids warrants for arrest, search or
seizure without "probable cause" is itself an absolute prohibition.” [17]
The warrant/Order issues by Judge Goeke and order heard by
Commissioner on its face was unreasonable because it lacked "probable cause" for the stated charge.[18]
Now if you could somehow get
past the constitutional requirement for REASONABLE probable cause and
prohibition of a “general warrant,” which you can not. The 8th Amendment’s requirement
that “nor cruel
and unusual punishments inflicted” for an alleged, later disproven,[19] misdemeanor traffic
violation precludes the imposed punishment, the deprivation of my home,
my son, my paternity and my liberty.
The Rule of Law, the “mere operation of law” as described
by Chief Justice John Marshal in Marbury v. Madison ,
the seminal Supreme Court case said, “The Government of the United States
has been emphatically termed a government of laws, and not of men. It will certainly cease to deserve this high appellation
if the laws furnish no remedy for the violation of a vested legal right.”[20] Of course the 1st
Amendment’s lawfully un-bridge-able right “to petition the Government for a redress
of grievances” the right to sue the sovereign/government for a justifiable
grievance under Article III and the 7th Amendment as timely and explicitly made precedent by Mr. Chief
Justice MARSHALL in Marbury v. Madison, 5 U.S. 163 (1803):
“The
very essence of civil liberty certainly consists in the right of every
individual to claim the protection of the laws whenever he receives an injury. One of the first duties of government is to
afford that protection. In Great Britain , the King himself is sued in the
respectful form of a petition, and he never fails to comply with the
judgment of his court.”
In
the third volume of his Commentaries, page 23, Blackstone states two cases in
which a remedy is afforded by mere operation of law.
"In
all other cases," he says,
"it
is a general and indisputable rule that where there is a legal right, there is
also a legal remedy by suit or action at law whenever that right is
invaded."
And
afterwards, page 109 of the same volume, he says,
"I
am next to consider such injuries as are cognizable by the Courts of common
law.[21] And herein I shall for the present only remark that all possible
injuries whatsoever that did not fall within the exclusive cognizance of either
the ecclesiastical, military, or maritime tribunals are, for that very reason,
within the cognizance of the common law courts of justice, for it is a settled
and invariable principle in the laws of England that every right, when
withheld, must have a remedy, and every injury its proper redress."
The Founding
Fathers, the Authors of the constitution, had lived for too long at the
discretion of the Nobility’s[22] absolute immunity with “no remedy for the violation of a
vested legal right” and sought to establish a reckonable[23] Rule of Law to replace
the Rule of the Nobility’s absolute immune prerogative. The Rule of Law is meaningless if the
ubiquitous absolute immunity[24] that empowered the Rule of
the Nobility in pre-revolutionary times is allowed to circumvent the Rule
of Law. The Rule of Law is therefore, by
definition, irreconcilably opposed to absolute immunity. There can be no Rule of Law if the law can be circumvented by absolute immunity.
I can prove my competency; I dare say the Judiciary’s asserted
unimpeachable incorporated competency could not sustain the Judiciary’s
unreasonable absolute immunity in a common law 7th Amendment controversy
before a Jury of OUR peers.
The immediate issue for the writer revolves around the Jane Crow era
in Family Law, where a man’s rights are secondary to the rights of any woman that
can feign tears:

Era, “It doesn't
take a cynic to point out that when a woman is getting a divorce, what she may
truly fear is not violence, but losing the house or kids. Under an exparte
order of protection, if she's willing to fib to the judge and say she is
"in fear" of her children's father, she will get custody and money
and probably the house.”

exparte order of protection has been brought starts to lose any power in his
divorce proceeding. They do start
decompensating, and they do start to have emotional issues, and they do
start developing post-traumatic stress disorders. They keep replaying in their
minds the tape of what happened to them in court. It starts this whole vicious
downward cycle. They've been embarrassed and shamed in front of their family
and friends, unjustly, and they totally lose any sense of self-control and
self-respect. They may indeed become verbally abusive. It's difficult for the

Admittedly the Jane Crow era of rampant deprivation of RIGHTS
is relatively new as compared to its predecessor the Jim Crow era. Jane
Crow and Jim Crow are both based on the conviction/lynching by infamous
accusation without access to 5th and 14th Amendment’s
access to Justice with the equal
protection of Due Process of Law.
I have referenced “To Kill a Mocking Bird, The Denial of Due Process,”
in several of my papers. I do so only because
the admittedly fictionalized facts of the case in “To Kill a Mocking Bird” are generally
known but not without standing Jane Crow era.
If the Sheriff Tate had investigated the accusations of Mayella Ewel, he
would have seen them for the racially motivated baseless vexatious[25] or calumnious[26] accusation against a crippled man
of good character that they were.
How could the crippled Tom Robinson been able to do the things he was
accused of?
If Horace Gilmer the prosecuting attorney had actually
looked at the evidence Atticus presented instead of blindly pushing the perjured
racially biased testimony of the Ewels he would have offered to dismiss the charges. If Judge Taylor had any of the altruistic, supposedly
independent, courage that our judiciary[27] is based on, he would
have dismissed the charge as vexatious[28] or calumnious[29] so as not to offend
the Ends of Justice that should have been
his PRIMARY motivation.
Tom Robinson was convicted because of the infamy of
the charge and the deliberate indifference to his right to justice under fair Due Process of
law as required and asserted in the Constitution for the United States of America
– the preamble to establish justice,
secure the blessings of liberty to ourselves and our posterity, Article III, §1 &
2,
Article. VI, 2nd Paragraph and the 4th, 5th and 14th
Amendment.
Atticus should not have had to say a word, just present the evidence of a
crippled since childhood man. The Sherriff,
the Prosecutor and the Judge are all representatives not of an ordinary party to
a controversy, but of a sovereignty whose obligation to govern impartially is as
compelling as its obligation to govern at all, and whose interest, therefore, in
a criminal prosecution is not that it shall win a case, but that justice shall be
done. As such, the Sherriff, the Prosecutor and the Judge are in a peculiar and
very definite sense the servants of the law, the two-fold aim of which is that guilt
shall not escape or innocence suffer. The Sherriff and the Prosecutor may prosecute
with earnestness and vigor -- indeed, they should do so. But, while they may strike
hard blows, they are not at liberty to strike foul ones. It is as much they’re duty
to refrain from improper methods calculated to produce a wrongful conviction as
it is to use every legitimate means to bring about a just one.
It is fair to say that the average jury (MOST everyday people), in a greater
or less degree, has confidence that these obligations, which so plainly rest upon
the judiciary, prosecuting attorney, and sheriff will be faithfully observed. Consequently, improper suggestions, insinuations,
and, especially, assertions of personal knowledge are apt to carry much weight against
the accused, when they should properly carry none. (paraphrased slightly from Berger v. United States, 295 U.S. 88 (1935))
Judges by definition in We the People’s system are there to independently
and altruistically enforce fair Due Process of law on the Sherriff, the Prosecutor
and the defendant as necessary to the ends
of justice.[30]
How can the malice, corruption,
dishonesty and incompetence[31] condoned and supported by Supreme Court precedent be constitutional in a
SANE government of the people, by the people and for the people?
This is a massive malicious, corrupt, dishonest and incompetent[32] self-serving conspiracy against
rights!!!
Historically,
the claim of precedent and / or consensus has been the first refuge of scoundrels;
it is a way to avoid debate by claiming that the matter is already settled. Absolute Immunity even in the supreme Court has
NEVER been established without, in most cases, multiple dissenting opinions.
To assume
that the founding fathers, who had enacted the Constitution of the United States
of America as the supreme Law of the Land, intended sub silentio to exempt[33] ANYONE, all evidence to the contrary, especially
those tasked with judicial,[34] prosecutorial[35]and enforcement[36] power from its paramount binding authority is
an incredible fantastic or delusional scenario.[37]
"Facts do not cease to exist because they
are ignored."[38]
This embarrasses the future and the past[39]
There are
no royal absolutely immune ruling persons/class in this country i.e., no titles
of nobility.[40] We
the People incorporated ourselves, in 1788, into a government of the people,
by the people and for the people to secure the Blessings of Liberty to ourselves
and our Posterity with a lawfully un-abridge-able right of the people to justifiably
petition the Government for a redress of grievances.[41]
How can the Supreme Court,
a delegated authority, acting under a sworn to constitutional commission award themselves and others “absolute
immunity”[42] from their constitutional commission to “do not only what their powers
do not authorize, but what they forbid”[43] i.e., the “deprivation of any rights, privileges, or immunities secured by the Constitution and laws
of the United States of America?”[44] by DENYING the constitutional
assurance of governmental accountability with 1st and 7th
Amendment Justice, law and equity?[45]
We
the People have fallen under
the despotic[46] spell of the concentrated power[47] in the Supreme Court that has created ABSOLUTE
POWER[48] from ABSOLUTE IMMUNITY for the “malicious
or corrupt” judges,[49] the “malicious or dishonest” prosecutor, [50] the “knowingly
