Oliver Cromwell (1599 – 1658) was the third of 59 of the trying court's members to sign the death warrant of Charles I. Charles I was executed on 30 January 1649. Charles I was a monarch and a corrupt despot. In the first MODERN struggle to displace a corrupt despotic King with SELF rule Oliver Cromwell was installed as the 1st Lord Protector of the Commonwealth of England, Scotland and Ireland on 25 December 1653 until his death five years later, 3 September 1658. During his reign and upon Cromwell's death there were those that wanted a restored monarchy.
To make a much more involved historical event simpler for my argument – I define the Cromwell effect as the assertion then and now that We the People cannot effectively GOVERN ourselves without an absolutely immune all powerful force.
During Cromwell's time they had no constitution. We the People's Constitution for the United States of America (1787-1788) is THE evolutionary offspring of Cromwell's failure. Our representative constitutional DEMOCRATIC government with STRICT reliance on the Jury system, both criminally and civilly, to establish Justice and to secure the blessings of liberty for ourselves and our prosperity is there as SECURITY, NOT a parchment guarantee only?
As an explanation of the Cromwell Effect's evolution, Montesquieu[7] (1689 – 1755) asserted three main forms of government, each supported by a social "principle": monarchies (free governments headed by a hereditary figure, e.g. king, queen, emperor), which rely on the principle of honor; republics (free governments headed by popularly elected leaders), which rely on the principle of virtue; and despotisms (enslaved governments headed by dictators), which rely on fear. Charles I was a monarchial despot[8] that was deposed, neither honored nor feared. The assertion as regards Cromwell's failure was the lack of a widely held principle of virtue, while the principle of honor required for a return of the monarchy, Charles II, still flourished.
Today in the We the People's government there is an ongoing assertion, that contrary to Montesquieu's assertion that a principle of virtue can guide us, We the People need a VIRTUALLY un-impeachable absolutely immune and independent authority to settle our disputes. Montesquieu's assertion of a principle of virtue will not hold. In Cromwell's time they thought they needed the King. In 1660 Charles II was invited back from exile to be king under a restored monarchy. On 30 January 1661, (symbolically the 12th anniversary of the execution of Charles I), Cromwell's body was exhumed from Westminster Abbey, and was subjected to the ritual of a posthumous execution.
What We the People currently lack is BELIEF in the principle of virtue. Our principle of virtue, our reciprocity for our fellow man, that makes a democracy and the Jury system work has been eroded by FEAR MONGERS. Literally, not figuratively FEAR MONGERS purporting that we need to deter crime with the fear of HANGING JUDGES, independent, all powerful and absolutely immune to our CIVIL RIGHTS to eradicate the otherwise unrestrained criminal element.
We forget the lessons of history. Deterrents have NEVER worked to eradicate crime. As has been pointed out, when pick pocketing was a capital crime, and pick pockets were publically executed, pick pockets went through the fleecing the crowd. Historically deterrents have been utilized arbitrarily, altruistically and judiciously to eradicate crime. Crime has been reduced but never eradicated. Any human application of deterrents, no matter the asserted logic, despotic or altruistic is flawed by its inherent humanity.
The lessons of history, FEDERALIST No. 51, "The Structure of the Government Must Furnish the Proper Checks and Balances Between the Different Departments" in the Independent Journal, Wednesday, February 6, 1788, by James Madison (1751–1836) at the ratification of our Constitution said:
"Justice is the end of government. It is the end of civil society. It ever has been and ever will be pursued until it be obtained, or until liberty be lost in the pursuit. In a society under the forms of which the stronger faction can readily unite and oppress the weaker, anarchy may as truly be said to reign as in a state of nature, where the weaker individual is not secured against the violence of the stronger; and as, in the latter state, even the stronger individuals are prompted, by the uncertainty of their condition, to submit to a government which may protect the weak as well as themselves; so, in the former state, will the more powerful factions or parties be gradually induced, by a like motive, to wish for a government which will protect all parties, the weaker as well as the more powerful. It can be little doubted that if the State of Rhode Island was separated from the Confederacy and left to itself, the insecurity of rights under the popular form of government within such narrow limits would be displayed by such reiterated oppressions of factious majorities that some power altogether independent of the people would soon be called for by the voice of the very factions whose misrule had proved the necessity of it. The lessons of history, "On the Origin of Species by Means of Natural Selection, or the Preservation of Favoured Races in the Struggle for Life" was published on 24 November 1859, a work of scientific literature by Charles Darwin (1809–1882). It is considered to be the foundation of evolutionary biology. For the sixth edition of 1872, the short title was changed to "The Origin of Species."
Herbert Spencer (1820 – 1903) originated the phrase "survival of the fittest" as an alternative description of natural selection. The phrase is today commonly used in contexts that are incompatible with the original meaning as intended by its first two opposing proponents: British polymath philosopher Herbert Spencer (who coined the term) and Charles Darwin.
Herbert Spencer first used the phrase, "survival of the fittest," after reading Charles Darwin's On the Origin of Species – in his Principles of Biology (1864), in which he drew parallels between his own economic theories and Darwin's biological ones, writing, "This survival of the fittest, which I have here sought to express in mechanical terms, is that which Mr. Darwin has called 'natural selection', or the preservation of favoured races in the struggle for life." Darwinism does not even contemplate anything as ephemeral as issues of a transitive societal or Lamarckism nature.
I have referenced "To Kill a Mocking Bird, The Denial of Due Process," in several of my papers. I do so only because the admittedly fictionalized facts of the case in "To Kill a Mocking Bird" are generally known but not without standing. If the Sheriff Tate had investigated the accusations of Mayella Ewel, he would have seen them for the racially motivated baseless accusation against a crippled man of good character that they were. How could the crippled Tom Robinson been able to do the things he was accused of? If Horace Gilmer the prosecuting attorney had actually looked at the evidence Atticus presented instead of blindly pushing the perjured racially biased testimony of the Ewels he would have offered to dismiss the charges. If Judge Taylor had any of the altruistic courage that our judiciary[9] is based on, he would have dismissed the charge as vexatious[10] or calumnious[11] so as not to offend the Ends of Justice that should have been his soul motivation.
Tom Robinson was convicted because of the deliberate indifference to his right to justice under fair Due Process of law as required and asserted in the Constitution for the United States of America – the preamble to establish justice, Article III, §1 & 2, Article. VI, 2nd Paragraph and the 14th Amendment.
Atticus should not have had to say a word, just present the evidence of a crippled since childhood man. The Sherriff, the Prosecutor and the Judge are all representatives not of an ordinary party to a controversy, but of a sovereignty whose obligation to govern impartially is as compelling as its obligation to govern at all, and whose interest, therefore, in a criminal prosecution is not that it shall win a case, but that justice shall be done. As such, the Sherriff, the Prosecutor and the Judge are in a peculiar and very definite sense the servants of the law, the two-fold aim of which is that guilt shall not escape or innocence suffer. The Sherriff and the Prosecutor may prosecute with earnestness and vigor -- indeed, they should do so. But, while they may strike hard blows, they are not at liberty to strike foul ones. It is as much they're duty to refrain from improper methods calculated to produce a wrongful conviction as it is to use every legitimate means to bring about a just one. (paraphrased slightly from Berger v. United States, 295 U.S. 88 (1935)) Judges by definition in our system are there to altruistically enforce fair Due Process of law on the Sherriff, the Prosecutor and the defendant as necessary to the ends of justice.[12]
How can the malice, corruption, dishonesty and incompetence[13] condoned and supported by Supreme Court precedent be constitutional in a SANE government of the people, by the people and for the people?
This is a massive malicious, corrupt, dishonest and incompetent[14] self-serving conspiracy against rights!!!
Historically, the claim of precedent and / or consensus has been the first refuge of scoundrels; it is a way to avoid debate by claiming that the matter is already settled. Absolute Immunity even in the supreme Court has NEVER been established without, in most cases, multiple dissenting opinions.
To assume that the founding fathers, who had enacted the Constitution of the United States of America as the supreme Law of the Land, intended sub silentio to exempt[15] ANYONE, all evidence to the contrary, especially those tasked with judicial,[16] prosecutorial[17]and enforcement[18] power from its paramount binding authority is an incredible fantastic or delusional scenario.[19]

This embarrasses the future and the past[21]
There are no royal absolutely immune ruling persons/class in this country i.e., no titles of nobility.[22] We the People incorporated ourselves, in 1788, into a government of the people, by the people and for the people to secure the Blessings of Liberty to ourselves and our Posterity with a lawfully un-abridge-able right of the people to justifiably petition the Government for a redress of grievances.[23]
How can the Supreme Court, a delegated authority, acting under a sworn to constitutional commission award themselves and others "absolute immunity"[24] from said constitutional commission to "do not only what their powers do not authorize, but what they forbid"[25] i.e., the "deprivation of any rights, privileges, or immunities secured by the Constitution and laws of the United States of America?"[26] by DENYING the constitutional assurance of governmental accountability with 1st and 7th Amendment Justice, law and equity?[27]
We the People have fallen under the despotic[28] spell of the concentrated power[29] in the Supreme Court that has created ABSOLUTE POWER[30] from ABSOLUTE IMMUNITY for the "malicious or corrupt" judges,[31] the "malicious or dishonest" prosecutor, [32] the "knowingly false testimony by police officers"[33] and "all (malicious, corrupt, dishonest and incompetent[34]) persons -- governmental or otherwise -- who were integral parts of the judicial process" [35] acting under color of law to wit, ABSOLUTE CORRUPTION.[36]

Judicial modesty is one of the best possible qualifications for a Supreme Court Justice, a position that offers so much untrammeled power and brings so much temptation along with it.

The Right of Petition is the right to substantive justice between the government and the people. This may truly be denominated the corner-stone of republican government; for so long as they are excluded, there can never be serious danger that the government will be any other than that of the people."
You some how want to argue that "the grant of Nobility" was about something other than the ROYAL Status of IMMUNITY. You want to argue that hereditary property rights were linked to a Colonial interpretation of Nobility? That would undermine Free-Enterprise.
Anyone that wants to assertion "the prohibition of titles of nobility' was meant to be anything more than a prohibition of theabsolute immunity of the nobility had been allowed, need only read the Petition of Right 1628 and note the consistent aversion to the asserted immunity of the nobility.
