Antonin Scalia and the LAW

Antonin Gregory Scalia (March 11, 1936 – February 13, 2016), was an American jurist who served as an associate justice of the supreme Court[1] of the United States from 1986 until his death in 2016.  Three years after he joined the court he wrote "The Rule of Law as a Law of Rules" -  56 U. Chi. L. Rev. 1175, 1175-81 (1989).  I quote him there:

"Predictability, or as Llewellyn put it, "reckonability," is a needful characteristic of any law worthy of the name."

The premise of the article is to assert that laws, to be useful for law enforcement, they need to be reckonable i.e., readily understandable.

Antonin Scalia: in the supreme[2] Court precedent Whitman v. American Trucking Associations, Inc., 531 U.S. 457 (2001) created the oft quoted legal axiom:

"Congress, we have held, does not alter the fundamental details of a regulatory scheme in vague terms or ancillary provisions—it does not, one might say, hide elephants in mouseholes."

I would agree 100% with both those assertions, but I would use them axiomatically in defense of the Constitution for the United States. 

In the history classes, I had, the Founding Father wrote the Constitution for the United States to be enforced as "reckonably" written for a jury of our peers. 

Article I (legislative) and Article II (executive) make the laws.  Article III (justice) enforces criminal and civil law by and with a local jury verdict.  And precedent can be useful, but judge-made-law Is not binding over-all.

Show me where in the 7,000 +/- words of the amended of the Constitution for the United States judge-made-law[3] is provided for or binding over-all[4]. 

It is obvious to anyone that can read - judge-made-law started the Civil War by enforcing Fugitive Slave Laws on the Free States in the North without the consent of their local juries.  And then went on to self-servingly enforce Jim Crow judge-made-law over the DEFEAT of the South and the clearly explicit assertions of the 13th, 14th, and 15th Amendments, their Constitutionally authorized Enforcement Acts[5] and the timely objections of Ida B. Wells[6], Justice John Marshall Harlan[7], and countless others!!!

The Founding Fathers wrote the Constitution for the United States to be reckonably understood by We the People and they did not hide "elephants in mouseholes"!

Article I, II, and "School-Yard-Rock" clearly define how to make law.  Show me where in the amended Constitution for the United States "judge-made-law" is called for or authorized?
